Jacob Davis (1801) and Susanna Miller of Ashe, Burke, Yancey, Cherokee and Graham Co, NC and Blount Co, TN

I (Marty Grant) am a 4th Great Grandson of Jacob Davis and Susanna Miller.

Special thanks to Joy Locke, Evelyn Tharp and others for data shared on this family. Also special thanks to Orville Wright Davis (deceased) for his book "The Davis Family Record" which gives a great deal of unique information about the Davis family.

Jacob Davis was born "1801" per several researchers. Census records give close, but varying ages. In 1850 he is age 50, or born ca 1799/1800. In 1860 and 1870 his ages agree with each other, being 57 and 67, or born ca 1802/03. Regardless of whichever of these is correct, they are all fairly close. He was born in the Three Mile Creek area of old Burke County. That area later became Yancey County (in 1833), and Mitchell County (in 1861) and today is Avery County (formed in 1911).

Jacob was probably named after his Uncle Jacob Carpenter.

Jacob Davis is a son of William Davis and Frances Carpenter. His connection to William is known via several sources, including family tradition, and the testimony of Jacob's oldest son (Isaac Thomas Davis), who knew his grandfather William Davis. The odd thing is that Jacob was not named in William Davis' Will. We only have the Court House copy of the Will, and not the original, so it is possible that he was named in the original, and the copy left him out inadvertently. In any event, there seems little or no doubt that Jacob is a son of William.

Jacob Davis was apparently with his parents for the 1810 and 1820 census in Burke Co, NC.

On 4 Jul 1825, Jacob Davis married his first cousin Susanna Miller (daughter of Jonathan Miller and Margaret Carpenter) at the Ashe County Court House. She was born and raised in Ashe County. No public record of the marriage has survived, but the date and location was recorded in their family bible. (From "The Davis Family Record" by Orville Wright Davis).

Jacob and Susanna moved back and forth, apparently, between Ashe County and Three Mile Creek. Their oldest child was born in Ashe in 1827, the next child in 1828 at Three Mile Creek, the next in 1830 back in Ashe. However, they were back at Three Mile Creek for the 1830 census, clearly in the Three Mile Creek area. He was next door to David Carpenter, his first cousin, and Bedford Wiseman on the other side. Other relatives were nearby, including Thomas Grant (my ancestor, but not related to the Davis family), John Vance (Jacob's brother-in-law), Lewis Vance (brother-in-law-in-law), Jacob's brother John Davis and their father William Davis were both on the next page, though in the same neighborhood.

Jacob was back in Ashe County by August of 1830, for their next child was born then, and in that county.  They apparently remained in Ashe at least until 1837, based on the birth places of their children.

On 21 Sep 1832 in Ashe County, Jacob Carpenter (Jacob Davis' Uncle) "of Burke" gave 100 acres of Ashe County land to "my son David" of "Ashe" for "natural love". The deed described the land as the same entered by Jacob Carpenter in 1800 on Left Fork of Rich Hill Creek. Jacob Davis witnessed the deed of his Uncle, along with Reuben Peppers. (Ashe Co, NC Deed Book M page 318).

Jacob and Susanna's grandparents, Mathias and Elizabeth Carpenter both died in 1835, Mathias in October. The heirs made several deeds among themselves dividing the vast land holdings that he had. All these deeds were dated 28 Oct 1835, and each deed named all the heirs.

In the above deeds, the sons of Mathias were all listed (David and Jacob Carpenter), and the daughters (Margaret, Mary, Christina and Franky). The daughters were listed with their husbands first (as was normal at the time), as "Jonathan Miller, Margaret Miller" and "Joseph Roten, Mary Roten", but in Franky Davis case, she was listed first, with "Jacob Davis" listed after her in every instance. This has confused some researchers into thinking that Jacob Davis was married to Franky Carpenter, daughter of Mathias. However, this is not the case. Jacob Davis was Franky's son, and my belief is, that since he already was living in Ashe County, he acted as agent for his father William Davis, who as already about 100 years old in 1835, and probably unable to go to Ashe to sign the various deeds. Since Franky, his wife, was only about 64, she was able to go. Hence her signature first, then Jacob Davis afterwards. The question then is, did Jacob actually receive the part of the inheritance meant for his parents? Or did he just sign for it. The reason I ask this, is, if Jacob actually received it for himself (presumably with his parents consent), then that would explain why he was left out of his father's Will, since he had already received a good inheritance via his grandfather Mathias Carpenter.

Regardless of how we interpret the above records, they clearly show that Franky Davis (his mother) and Jacob Davis, sold several portions of the inheritance to the the others, and received just one tract of 200 acres on Mill Creek. The deed was to "Jacob Davis" and didn't mention Franky.

I don't know who actually owned the above land, whether Jacob Davis, or his parents, or just his mother, or him and his mother. The deed seems to give it only to him, but I haven't yet found (nor looked) to see how this land was later disposed of, whether he, or someone else, sold it later on.

Jacob Davis' father William made his Will in Yancey County on 9 May 1836. For one reason or another, he did not name his son Jacob Davis in the Will. Perhaps it is because, as I suggested before, that Jacob already received the 200 acres in Ashe County from the Mathias Carpenter estate, or perhaps it was for some other reason. (Yancey Co, NC Will Book 1 page 156).

Jacob Davis remained in Ashe until at least 1837, when a child was born there in January. Sometime between then and June 1839, they moved to the Cades Cove area of Blount County, Tennessee. Several other Toe Valley families had moved there as well, so they apparently followed the migration. There were several Davis families already there, prior to 1830, and I've long felt that some of them might be related, though have yet to prove any connection. Jacob's brother Thomas Davis has preceded him there by about 3 years or so. Perhaps he sent back a good report and enticed Jacob to join him.

Jacob Davis was listed on the 1840 census in Blount County, Tennessee. He was listed on the same page with his brother Thomas Davis, and also with a John Davis, whom some have mistakenly assumed was their brother John Davis, however, their brother John did not go to Blount Co, TN. It is possible that this John Davis in Blount in 1840 was a relative though, perhaps a first cousin to them, a son of one of William Davis' brothers. In 1840, Jacob had one "extra" adult male, in his 20's, residing with them. I don't know who this was. He may have been a hired laborer, or a relative.

Jacob and family left Blount County, TN sometime after October 1846, but before October 1848 and moved to the Cheoah Township area of Cherokee County, North Carolina (now Graham County), where they settled on or near Sweetwater Creek. Jacob's brother Thomas Davis had also made the same move around the same time, settling not too far from Jacob.

Jacob and family were listed on the 1850 census in Cherokee County, NC. Jacob's cousin (and soon to be son-in-law) William Carpenter was residing with them.

Jacob and family were listed on the 1860 census in Cherokee County, in Cheoah Township. This census taker had the wonderful foresight to record the actual county of birth for each person, when only the state was required. Jacob's brother-in-law William Davis was about six households away in 1860, having moved down from Three Mile Creek just a year or so before.

The Civil War saw all the older Davis sons enter the Confederate service (all but Isaac Thomas who was blind), and two of the three who entered died during the war.

Jacob Davis made his Will in Cherokee County, NC on 28 Dec 1869, naming his family members as heirs. Though he didn't die until 1873. Interestingly, it was a joint Will, though only in his name, both he and wife Susanna signed it. It is recorded in Cherokee County Will Book G page 176.

The last Will and Testament of JACOB DAVIS of Cherokee County, North Carolina. In the name of God, Amen. I JACOB DAVIS of the County and State aforesaid, being mindful of the uncertainty of this natural life and also, of sound mind and disposing memory and desirous to make such a disposition of my earthly effects, with which it has pleased a gracious God to bless, that after my death, no complaint may be made about the same, do make and publish and declare this my Last Will and Testament.

First I will my body to the dust and my soul to the God who gave it.

Second: It is my will and desire that all my just debts shall be paid, after paying my Doctor Bill, burial expenses and all other expenses incident thereto.

Third: To my Grand Children, NANCY M, MARY A, and MARGARET M, children of my daughter CELY L. DEAVER, in addition to advancements made I give and bequeath to them the sum of Five Dollars each and no more to NANCY M and MARY A. to MARGARET M. in addition, I give one feather-bed and its necessary furniture, one cow and calf and two head of sheep.

Fourth: To my son ISAAC T. I will and bequeath one horse, bridal and saddle, one cow and calf, also Two Hundred and eight acres of land, lying and being in said County on Slay-bacon Creek.

Fifth: To my daughter FRANCES M SHERRILL, in addition to advancements made to her, I will and bequeath, one side saddle, also the One-third part of my Interest in three general mountain tracts of land, two of said tracts lying on Bear Creek, Waters of Tallula, the other lying on Mountain Town Creek.

Sixth: To my daughter, MARY M GIBSON, in addition to advancements made to her I give and bequeath one third of the last aforesaid tracts of land.

Seventh: To my daughter MARGARET M CARPENTER, in addition to advancements made to her, I give and bequeath to her one other third of the last aforesaid tracts of land.

Eight: To my sons JONATHAN M and MARION T. who are now with me, and who have not received anything from me, heretofore. I give and bequeath to them my home place, consisting of three tracts of land, containing, four hundred and ninety nine acres, more or less, lying on Sweetwater Creek, also one mountain tract containing one hundred acres, and adjoining, also all my farming tools, Black smith tools & (c. Cards?) and tools to be equally divided between them according to value as they agree between themselves or by friends chosen by them.

Ninth: To my daughter RACHEL E, I give and bequeath two tracts of land on the waters of Tallula Creek, containing fifty acres each, one bought of JAMES S WRIGHT, the other of CALEB WINFREY, also the undivided half of a tract of land containing sixty acres, bought of JAMES S WRIGHT on the waters of Tallula Creek, and adjoining the other two, also one horse, bridal and saddle, one feather bed and its necessary furniture, one cow and calf and two ewes and lambs.

Tenth: To my daughters RACHEL E, FRANCES M SHERRILL, MARY M GIBSON and MARGARET M CARPENTER, after deducting the specific legacies, to wit; Beds and their necessary furniture. I give and bequeath the remainder of my house hold and kitchen furniture;

Eleventh: It is my will and desire, after paying to my children the specific legacies, to wit; the cows and calves, ewes and lambs, the horses, Bridals and saddles as aforesaid mentioned, that the remainder of my personal property, not otherwise disposed in this my said Will, shall be sold and their proceeds equally divided between my children and their children, should they die, leaving any except the children of my daughter, CELY L DEAVER; to wit; NANCY M, MARY A and MARGARET M. And further should I die seized and possessed of any other lands and interest in lands, not otherwise disposed, it is my will and desire that said lands and interest in lands be equally divided as least above mentioned with the like exceptions. And further it is my will and desire, shall I die, leaving my beloved wife SUSANNA, who has been partner of my joys and sorrows through a long life and who has contributed greatly in acquiring property I now possess, that my sons JONATHAN M and MARION T, shall provide a home and support for her during her life free of charge to anyone else but themselves.

Twelfth. In conclusion, whereas it is my desire that each and every particular in this my aforesaid Will, may be carried out in good faith, and that all differences between my children, after my death may be quieted and that no suit of law may be instituted by them. I do hereby enjoin upon the administration, whom the law may appoint to use his best efforts in the premises and in all disputes that may arise for the purpose of settling the same amicable and with as little cast as possible, he submit the same to mutual friends. I hereby declare this to be my last Will, and revoking all others by me made. In witness whereof I hereunto set my hand and seal in the presence of. This the Twenty eighth day of December in the year of our Lord one thousand eight hundred and sixty nine.

State of North Carolina Graham County. Office of Judge of Probate. It appearing to the satisfaction of the Court here, that JACOB DAVIS departed this life the 7th day of February AD 1873 having published a last will and testament and it further appearing that the last Will and Testament contains no provisions for its execution and the said Will and Testament having been probated according to law on the Testimony of the subscribing witnesses thereto and it appearing satisfactory to the devisees and Legacies and no other person coming to question it. It is adjudged and decreed that letters of Administration with the Last Will and Testament shall be and is hereby given to SUSANNA DAVIS, WILLIAM CARPENTER and N M E SLAUGHTER upon the filing of a Bond for the sum on One Thousand Dollars ($1000.00).

And this Letter shall authorize them to enter in and take possession of all such property that may be found belonging to the office according to Law.

The section of Cherokee County they lived in was cut off to form the new Graham County in 1872.

Jacob Davis died in Graham County on 7 Feb 1873. His date of death is included on the probate portion of his Will (see above). I don't know where Jacob is buried, and to my knowledge, no one has located his grave. Some believe he was buried at the Campbell - Sherrill Cemetery in an unmarked grave, or perhaps he is buried on his own property in an unmarked grave.

Susanna Miller Davis was listed on the 1880 census in Graham County, residing with her son Taylor Davis.

Susanna died in August 1895 in Graham County. She is presumably buried next to Jacob Davis, wherever he is.

Jacob Davis and Susanna Miller had twelve children, all named and their birth dates given in a Family Bible Record (I don't know who has this bible now). The book "The Davis Family Record" says it was William Carpenter's Bible, but I didn't see these births recorded there in my copy. Jacob Davis' Will of 1869 names most of his children.

Celia Lucinda Davis was born 9 Feb 1827 in Ashe Co, NC (date per Family Bible). She may have been born in Three Mile Creek in Burke (later Yancey, later Mitchell, now Avery) Co, NC instead.

Celia was apparently with her parents for the 1830 and 1840 census.

Celia married Thomas Jefferson Deaver on 15 Aug 1844 in Blount Co, TN. I didn't find a public record of this marriage. Presumably this date is in the Family Bible. Thomas was born in Blount Co, TN. His parents (William Deaver and Elizabeth Mackey), married there in 1821, and they also came to the Cherokee (now Graham) Co, NC area by 1850.

Thomas and Celia were listed on the 1850 census in Cherokee Co, NC, just a few houses from his parents and from hers.

Celia died in Cherokee (now Graham) Co, NC on 15 Sep 1856. I don't know where she is buried.

A year or more after Celia's death, Thomas married Angeline Kirkland in Cherokee Co, NC. I found no marriage record, but they married ca 1858/59.

They were listed on the 1860 census with his and Celia's children as well as one new child (John).

Thomas J. Deaver served in the Civil War and died on 10 Jan 1865 in Knoxville, Tennessee.

Jacob Davis, Celia's father, made his Will in Cherokee Co, NC in 1869. He named "Nancy M., Mary A., and Margaret M.", children of his daughter "Cely L. Deaver". He didn't mention Susan P. Deaver, so perhaps she had died by 1869.

Widow Angeline Kirkland Deaver married on 20 Dec 1867 in Cherokee Co, NC to John Hampton Millsaps.

For the 1870 census, Hampton (listed as "John") Millsaps and Angeline were listed in Cheoah Township, with her two children by Thomas J. Deaver residing with them (listed as "Millsaps" though), only step-daughter Mariah Margaret Deaver was still unmarried, but she was residing with her grandparents, Jacob and Susanna Davis.

Hampton and Angeline Millsaps were in 1880 Graham Co, NC with no children.


Isaac Thomas Davis was born 7 Sep 1828 in Burke County, NC in the Three Mile Creek area. This area later became Yancey County (in 1833) and Mitchell County (in 1861) and finally Avery County (in 1911).

Isaac Thomas was probably named, in part, after his Uncle Thomas Davis.

Isaac T. Davis was apparently home with his parents for the 1830 and 1840 census. He was with them in 1850 and 1860.

On 28 Dec 1869, Jacob Davis named him as "my son Isaac T."  in his Will in Cherokee Co, NC. (Cherokee Co, NC Will Book G page 176)

I did not locate Isaac Thomas in 1870. He was not with his parents, nor did I find him elsewhere in Cherokee County, NC.

In 1872, the section of Cherokee County where they lived was cut off to form Graham County.

Wherever he may have been in 1870, he was back in Graham County by 1880, and residing with his brother Jonathan Miller Davis.

Jonathan Miller Davis died in 1909, and his wife Julia in 1906. Isaac Thomas remained residing with this family though, listed on the 1910 census with their son (his nephew) Commodore Davis.

Isaac Thomas Davis died in Graham County on 16 Jan 1915, and was buried at Old Mother Cemetery (Cheoah Church) in Robbinsville. His marker says "Isaac Thomas Davis 1830 - 16 Jan 1915".

His death certificate gave his parents as "Jacob Davis" and "Elizabeth Miller". His father's name was right, but his mother was wrong, it should have said "Susanna Miller". This record has caused some researchers to erroneously list Susanna as "Susanna Elizabeth Miller", but that was not her name, and it should be remembered that death certificates are notoriously inaccurate concerning the parents names of the deceased. About the only time it is accurate was when the informant was a sibling, or a child, but who knew the grandparents personally. In this case, I don't know who the informant was.

Isaac Thomas Davis was mentioned prominently in "The Davis Family Record" as a major source for family information on the Davis family. According the author, Orville Wright Davis, "Uncle Thomas" handed the stories down to Robert Lee Davis (oldest son of Jonathan Miller Davis), who in turn told them to others. Of course, you have to assume family traditions get inaccurate after numerous retellings, but there is always a grain of truth, and often they are very accurate, depending on how far the source was removed from the actual subject. Uncle Thomas spoke about his grandfather: the near legendary William Davis, as well as stories about his other kinfolks, including parents.


Frances Malinda Davis was born 4 Aug 1830 in Ashe County, NC, She was apparently named, in part at least, after her grandmother Frances Carpenter.

Frances was apparently with her parents for the 1840 census in Blount Co, TN.

On 5 Dec 1847, Michael Simpson Sherrill obtained a marriage bond in Blount Co, TN to marry Frances Malinda Davis. They were married on 12 Dec 1847 (per Bible record, I believe). The marriage bond gave "Michel Sherrell" and "Franky Davis", by William Deaver, JP.

The Sherrill's made the same move from Blount County, TN to Cherokee (now Graham) Co, NC before 1850. Michael and Franky were listed on the 1850 census in Cherokee Co, NC next door to her parents.

Michael and Franky and family were still in Cherokee for the 1860 census. They were listed next to my ancestor (but not related to them) Charles N. George, who lived at the Head of Tulula Creek, and records show they lived in the same area.

Michael died in January, 1909 in Graham County, and Franky on 1 May 1909. They are buried at the Campbell - Sherrill Cemetery (named in part for them). His marker says "Mike Sherrill Apr 1828 - Jan 1909", and hers "Frankie Sherrill Aug 1830 - May 1909". I've been to their graves one time, ca 1990.


Mary Matilda Davis was born 27 Dec 1832 in Ashe County, NC. She may have been named, in part, after her Aunt Mary Miller Weaver.

Mary was apparently with her parents for the 1840 census in Blount Co, TN, and she was with them in 1850 Cherokee Co, NC.

Mary married Wesley Gibson on 28 Dec 1856 in Cherokee (now Graham) Co, NC. This marriage date is from the Family Bible, I believe.

Wesley and Mary were in Cherokee Co, NC for the 1860 census. They were next door to her first cousin (and my ancestor) William Carpenter.

In 1872, Graham County was created from the section of Cherokee where they all lived.

I did not find the Gibsons on the 1880 census. Wesley's father Joshua Gibson was still in Graham County, but I did not find Wesley in that county. They must have moved away somewhere.

I have a death date for Mary as 10 Jul 1896, but I'm not sure where she died.


Margaret Ann Davis was born 30 Jan 1835 in Ashe County, NC. She was probably named after her grandmother Margaret Carpenter Miller.

Margaret married her 2nd cousin William Carpenter on 11 Dec 1855 in Cherokee (now Graham) Co, NC. They are my ancestors.

William Harrison Davis was born 18 Jan 1837 in Ashe County, NC, the last child born before the family moved to Blount County, Tennessee.

William was probably named after his grandfather William Davis.

William was apparently with his parents for the 1840 census in Blount Co, TN. He was home with them in 1850 Cherokee Co, NC.

William married Nancy E. Medlin on 20 Nov 1859 in Cherokee Co, NC (now Graham Co, NC). She was  a daughter of Louis Medlin and Jane Welch.

William and Nancy were listed on the 1860 census in Cherokee Co, NC, just a few houses from his sister Frances Sherrill.

For the Civil War, William H. Davis enlisted on 28 Mar 1862 in Company D, 25th Regiment, North Carolina Troops (Confederate) as a Private. He was age 24 when he enlisted (per his records). He was wounded through the thigh at Fredericksburg, VA on 13 Dec 1862. His leg was amputated, and he died in the Hospital at Lynchburg, VA on 7 Jan 1863 due to the wounds and pneumonia.

Apparently, William and Nancy had no children together during their brief marriage.

After the War, widow Nancy returned to Macon Co, NC (probably still had relatives there) and there she married John Love Sawyer on 8 Jul 1866. It was a second marriage for both, he had previously been married to Nancy Louisa Welch (married on 2 Jul 1855) who had died between 1862 and 1866.

John and Nancy lived in the part of Macon County that became Swain County in 1871. John died in Swain County on 3 Mar 1903, and Nancy died there in 1929.


Nancy Adeline Davis was born 28 Jun 1839, presumably in Blount Co, TN. Nancy was possibly named after her Aunt Nancy Davis Burleson and Aunt Nancy Miller.

Nancy Adeline apparently died young, as there is no further record of her. She did not seem to be with the family for the 1840 census, so probably had died very young, perhaps while still a small infant. If she was born in Cades Cove, TN, she is probably buried there as well.


Sarah Jane Davis was born 4 Dec 1841, presumably in Blount Co, TN. Sarah was possibly named after her Aunt Sarah Miller.

Sarah Jane apparently died young, as there is no further record of her. She was not with the family for the 1850 census, so she died before then most likely. She either died in Cades Cove, TN where she was born, or after the move (ca 1848-1849) to Cherokee Co, NC.


Jonathan Miller Davis was born 5 Jul 1844 in Blount Co, TN. "Jonathan Miller Davis" was obviously named for this grandfather Jonathan Miller.

Jonathan was home with his parents for the 1850 and 1860 census.

He married Julia Ann Elizabeth Shepherd on 19 Dec 1866 in Cherokee (now Graham) Co, NC.

Mathias Washington Davis was born 7 Oct 1846 in Blount Co, TN. He was probably named after his Uncle Mathias Miller, who in turn was named for Mathias Carpenter.

Mathias was home with his parents for the 1850 and 1860 census in Cherokee Co, NC.

He apparently enlisted for the Civil War, but I haven't found his records yet. He died during the War, but I don't have the details yet, so I don't know when, where or how.


Marion Taylor Davis was born 25 Oct 1848 in Cherokee (now Graham) Co, NC. The first of his family to be born after the move from Cades Cove, TN. I'm not sure who, if anyone, he was named after. He had a Great Uncle named Isaac Taylor, but he seems a little too distant to be a namesake.

Taylor was home with his parents for the 1850 and 1860 census in Cherokee County.

Taylor married Rebecca Jane Rice on 20 Feb 1870 in Cherokee (now Graham) Co, NC.

Rachel Elizabeth Davis was born 3 Mar 1851 in Cherokee (now Graham) Co, NC. She probably had several namesakes, having an Aunt Rachel Davis Davis, and Elizabeth Davis Vance and Elizabeth Miller Weaver.

Rachel was home with her parents for the 1860 census in Cherokee Co, NC.

Rachel married Thomas Jefferson Ammons on 12 Aug 1869 in Cherokee (now Graham) Co, NC. Their marriage record listed them as "Thomas J. Ammons" and "Rachel Davis", married by Allen Ammons, MG.

On 28 Dec 1869, Jacob Davis made his Will and named Rachel as "my daughter Rachel E.", but gave no surname for her. (Cherokee Co, NC Will Book G page 176).

Thomas and Rachel were listed on the 1870 census next to her sister Frances Sherrill.

Sometime between 1900 and 1910, the Ammons family left Graham County, with several other families and moved out west to Texas. 

Rachel died in Vernon, Texas on 7 Nov 1926, and Thomas died there one month later on 8 Dec 1926.
