William Davis (1809) and Rachel Davis (1810) of Burke, Yancey, Cherokee and Graham Co, NC[Commentary] [Children] [Researcher List] [Register Report] [A Note about sources] [How to contact me] [Home] I (Marty Grant) am not related to William Davis as far as I know, but I am a 4th Great Grand Nephew of Rachel Davis. Special thanks to Ralph Cody (deceased) and Evelyn Tharp for data shared on this family. Ralph Cody shared family Bible records with me showing the birth and death dates, and some marriages dates for this family. The text of this bible is included at the end of this commentary section. William Davis was born 18 Jun 1809 (per Family Bible) in Iredell County, North Carolina (proven by 1860 census). This fact, and his association with several other Davis families, and the Houston family lead Ralph and I to conclude that William was probably a son of Andrew Davis and Miss Houston of Iredell and Yancey Co, NC. We have no direct proof of that connection, but the circumstantial evidence is nearly overwhelming. First, William Davis (1809) married Rachel Davis (1810) daughter of William Davis (Sr) and Frances Carpenter in 1832 in Yancey Co, NC. Andrew Davis Sr was a neighbor to William Davis (Sr). Andrew Davis came to Yancey from Iredell County, NC. Several of Andrew's children were also born in Iredell as was William (1809). Andrew's wife was a Miss Houston, and in William's (1809) Bible, he named several Houston family births. William (1809) was neighbors to several of Andrew's children in Yancey Co, NC and all (or most) of them moved to Graham Co, NC and they were neighbors there as well. None of this conclusive proof that Andrew is William's father, but it is strong enough for now. Assuming (as I have) that William (1809) was a son of Andrew Davis, then we find that he was probably home with Andrew in the early census records. In 1810, Andrew Davis was listed in Iredell Co, NC, and he did have a son under 10 (born ca 1800/10), which could be William-1809. In 1820, Andrew Davis was still in Iredell, and had a son in the 10-15 age group (c1804/1810), which is a perfect fit for William-1809. In the 1820's, Andrew moved his family from Iredell County to the Three Mile Creek area of Burke County (soon to become Yancey County). He was listed there on the 1830 census, with a son age 20-29 (c1800/10), a perfect match for William. On 14 Sep 1831, William Davis and Lewis Vance (his brother-in-law) were bondsman for a marriage bond in Burke County for James Buchanan and Delpha Davis (whom I think was William's sister). William Davis married Rachel Davis on 8 Apr 1832 in Burke (later Yancey) Co, NC. This date is from their Bible, and was not found on the Burke County Marriage records. Family tradition is clear about "Bill" Davis and Rachel not being related to one another. Rachel Davis was born 21 Jun 1810 (per family Bible) in the Three Mile Creek area of Burke (now Avery) Co, NC. She is a proven daughter of William Davis and Frances Carpenter. She was named in William's Will (1836) as "my daughter Rachel Davis". Rachel was apparently not born yet as of the 1810 census (she was born shortly after the census taker came around, probably), so not listed with her parents in 1810. She was apparently home with William Davis (Sr) in 1820, and 1830. William Davis-1809 began appearing in public records as William Davis "Jr" to distinguish himself from his father-in-law William Davis "Sr". This was necessary to keep them straight in the public records (deeds, taxes, etc). On 9 May 1836, William Davis (Sr) made his Will in Yancey County, naming his wife and children, including "my daughter Rachel Davis". On 28 Dec 1836, "William Davis Jr" received a State Land Grant in Yancey Co, NC. It was for 50 acres in Yancey County, bordering William Davis Sr. No distinguishing landmarks were mentioned. (Yancey Co, NC Deed Book 1 page 157 from "Index and Abstract of Deeds of Yancey Co., NC Deed Book 1" by Sally Williams, 1985). William Davis (1809) was not listed on the 1840 census as head of household. It didn't take long to find him though. He was apparently residing with his father-in-law William Davis Sr that year, as William Sr's household had a large number of "extra" people in it, including several perfect fits for William Jr, Rachel and their children. There were several others also, who were a good fit for William Jr's brothers and sisters (who's father Andrew had moved to Cocke Co, TN by this time with his 2nd wife). I am 99% sure this is William, Rachel and their kids with her father William in 1840. There is a slim chance this isn't them, but I don't think that is the case. He was listed as William "Jr" since his father-in-law William "Senr" was also listed. He was taxed for 300 acres, valued at $125, and he had one poll (himself), and his tax was $2.12. (Toe Valley Genealogical Society Newsletter, Volume 5, Number 8, October 1993, 1840 Yancey County Tax List, Capt Vance's Company by Kathy Sullivan) Only one "William Davis" was listed on the 1841 tax list in Yancey. This was the year that William Sr died, so I'm assuming the entry was for "Jr", but without "Sr" around, there was no need to continue being referred to as "Jr". He was listed in Captain Swan's Company, charged with 560 acres (260 acres more than the year before, does this reflect an inheritance from William Sr?), valued at $300, with 1 white poll (himself). (Toe Valley Genealogical Society Newsletter, Volume 5, Number 9, November 1993, 1841 Yancey County Tax List, Capt Swan's Company by Kathy Sullivan) In the Spring 1848 term of Yancey County Court, the Valuations of Yancey County lands were all reduced by 33 1/3 cent per acre. William Davis was listed in North Toe River District with his land of $1000 reduced to $666 2/3. His land value had increased a great deal since 1841. (Toe Valley Genealogical Society Newsletter, Volume 2, Number 6, August 1990, "Yancey County Court of Pleas and Quarter Sessions Minutes to Spring Term 1848" extracted by Rhonda Gunter) On 8 Sep 1849 Jacob Carpenter (Rachel's Uncle) made his Will in Yancey County, NC naming his heirs. William Davis and his son George W. Davis were the witnesses. (Yancey Co, NC Wills Book 1 Page 111) William and Rachel and family were listed on the 1850 census in Yancey Co, NC. They were only eleven houses from William's brother Andrew Davis (Jr), and just three houses from the first of several of Rachel's Carpenter cousins, and just five houses from her Uncle Jacob Carpenter. Rachel's sister Nancy Davis Burleson was just 12 houses away. William and Rachel's neighbors on either side were John Ollis, and Levi Houston, age 41, who I believe might be a first cousin of William's, but I can't prove that yet. However, the birth dates for Levi Houston and several of his children were listed in William Davis' family bible, so that seems significant. William and Rachel had William Vance age 20 with them, listed as a laborer. I'm fairly sure this is a son of Lewis Vance and Isabell Davis (William's sister), making him William Davis' nephew.

Davis must have sent home a good report of the land in Cherokee Co, NC, for during the 1850's, William and Rachel decided to move down there as well. They settled very close to Jacob and Miles in the Cheoah Township section of Cherokee County (which later became Graham County). William and Rachel and family were listed on the 1860 census in Cherokee County, NC just six houses from Rachel's brother Jacob Davis, and just one page from William's brother Miles H. Davis. Several of William's sisters also moved to this area with their families at the same time. William's nephew John Cody was residing with them in 1860. I think he is the same John Cody who was a son of Godfrey Cody and Caroline Davis. John later married William's daughter Mary Jane Davis. The census taker for Cherokee County in 1860 (bless his heart) took down not only the state of birth for everyone, but also the county!

Before 1870, nearly the entire family was dead. I don't know (yet) if these deaths were a direct result or by-product of the Civil War, though most occurred during the War. Son George died in 1862. Son Thomas in 1862. Son Jacob in 1864. Son John in 1865. Mother Rachel in 1865. Daughter Frankie in 1866. Daughter Josephine in 1866. By the time of the 1870 census, only William and his daughter Mary were still living. Rachel Davis Davis died on 9 Sep 1865 (date per family Bible). She is probably buried at the Old Mother Cemetery (Cheoah Church) in Lot Number 82, in an unmarked grave (based on Church and Cemetery records). William Davis was listed on the 1870 census in Cherokee County, NC. He was listed in Cheoah Township, just two houses from his brother Miles H. Davis, and just six houses from his Rachel's first cousin David Carpenter. Though William's entire family (except daughter Mary) had died, he was not alone in 1870, he had a full house. He had Mary Mitchell, age 40, and Mary Mitchell age 15 (daughter of elder Mary?) with him. I don't know if they were related to him somehow or not. He also had his widowed son-in-law Gabriel Rice with him (married to Josephine Davis, who died in 1865), and his daughter Sophronia Rice. Lastly he had Cemantha Patterson, age 14. She was an orphan of Uriah and Lavina Patterson, though I don't know how (or if) she was related to William Davis. In 1872, Graham County was formed from part of Cherokee County, and included the area where the Davis family lived. William Davis died on 2 Oct 1874 in Graham County. He is probably buried at the Old Mother Cemetery (Cheoah Church) in Lot # 66 in an unmarked grave. There seem to be "two" William Davis Family Bibles. One was probably the original, and it seems to be written in William's own hand (he refers to Rachel as "my wife"), and the other is probably a copy made, either for one of their children, or because the original was in bad shape (and it is hard to read). From what I can tell, there were no differences in the names or birth dates of William and Rachel's children. But there were differences in the way it was worded. On closer inspection, it seems the 2nd Bible was probably the Bible of Mary Jane Davis and her husband John A. Cody. "Family Record" section from William Davis Family Bible (original Bible, I think). ChildrenWilliam and Rachel had nine children, all named in the Family Bible, and eight of them also proven by the 1850 and 1860 census records. All of the birth and death dates for them are recorded in the Bible. Frances Elizabeth Davis (1839) George W. Davis was born 5 Apr 1833 (per William Davis and John A. Cody Bible record) in Yancey Co, NC (now Avery Co, NC). I don't know who he might have been named after (besides George Washington, most likely). He was apparently home with his parents for the 1840 census. On 8 Sep 1849 George witnessed the Will of his Great Uncle Jacob Carpenter in Yancey Co, NC. George was home with his parents for the 1850 census in Yancey Co, NC. George was not with his parents in 1860 Cherokee Co, NC census. He may have remained in Yancey (I didn't find him there in 1860 either), or perhaps he had moved somewhere else. The family Bible reports that George died on 13 Aug 1862, but does not say where, nor if he was involved in the Civil War. He was old enough to have been, so probably was. (per William Davis and John A. Cody Bible record) I don't know if George ever married. John Harvey Davis was born 3 Jan 1835 (per William Davis and John A. Cody Bible record) in Yancey Co, NC (now Avery Co, NC). He might have been named, in part, after his Uncle John Davis. He was apparently home with his parents for the 1840 census in Yancey County, and with them for sure in 1850 Yancey (listed as "John H. Davis"). He went with them to Cherokee Co, NC, and about the year 1860 he married Frances Eliza Wiggins, daughter of Abraham Wiggins and Margaret Deaver. John and Eliza were listed on the 1860 census in Cherokee Co, NC, three houses from his parents, and three houses from his Uncle Jacob Davis. They had no children yet, so probably just married within the past year or so.

Davis died on 2 Apr 1865. He may be buried at the Old Mother Cemetery (Cheoah Church) in Lot # 68 in an unmarked grave. John's widow Eliza Wiggins Davis married William F. Cooper ca 1868. He was a son of James C. Cooper and Violet Mackey. William and Eliza were listed on the 1870 census in Cherokee Co, NC just three houses from her father-in-law William Davis. She had two Davis children, and also had Andrew Patterson with her. He was a brother of Cemantha Patterson who was living with Eliza's father-in-law William Davis in 1870.

Of the two Davis children, Robert died young, and Roena married Byrd Thompson in 1883. I don't know when William Cooper nor Eliza died, though I think both died in Swain County, NC. William N. Davis was born 16 Feb 1837 (per Bible record) in Yancey Co, NC (now Avery Co, NC). William was probably named after his father William, and grandfather William Sr. I don't know what the "N" middle initial might stand for. He was apparently home with his parents for the 1840 census, and with them for sure in 1850 Yancey County. He moved with them to Cherokee County, and was with them on the 1860 census. The Family Bible reported that William died on 29 Apr 1862, but does not say where, nor if directly related to the Civil War. He was of age to have served, so he may have been a soldier. Frances Elizabeth Davis was born 5 Jun 1839 (per Bible record) in Yancey Co, NC (now Avery Co, NC). She was probably named after her grandmother Frances Carpenter Davis, as well as after her Aunts Frances Davis Burleson and Elizabeth Davis Vaughn Vance and Elizabeth Davis Cody (several namesakes to choose from!). Franky was apparently with her parents for the 1840 census, and with them for sure in 1850. She went with them to Cherokee Co, NC, and was listed with them there for the 1860 census. Franky married Wiley J. King sometime after 1860, but before 1866. The Family Bible record shows Franky dying on 12 Jan 1866, presumably in Cherokee (now Graham) Co, NC. She is probably buried at Old Mother Cemetery in Lot # 69 in an unmarked grave. I don't think Franky and Wiley King had any children together, or at least none to live. Wiley married again on 15 Nov 1866 in Cherokee Co, NC to Sarah Elmina Amanda Cooper, daughter of Thomas Jefferson Cooper and Frances Deaver. Wiley and family were on the 1870 census, just four houses from former father-in-law William Davis. None of their children were old enough to predate their 1866 marriage, so apparently none belonged to Wiley's first wife Franky Davis.

Josephine Louisa Davis was born 14 Nov 1841 (per Bible record) in Yancey Co, NC (now Avery Co, NC). I don't know who she might have been named for. Louisa was with her parents in Yancey Co, NC for the 1850 census. She moved with them to Cherokee Co, NC during the 1850's. Louisa married Gabriel Pinkney Rice in Cherokee County (now Graham County) ca 1859. Gabriel and Louisa were listed in Cherokee County, NC for the 1860 census, in Cheoah Township. They were seven houses from her Aunt Elizabeth Davis Cody. They had no children yet, so that probably indicates they were recently married.

She is probably buried at the Old Mother Cemetery in Lot # 70 in an unmarked grave. As noted previously, Gabriel and their child Sophronia, were residing with William Davis for the 1870 census. Gabriel Rice married Mary Josephine Mitchell on 3 Mar 1872 in Cherokee (now Graham) Co, NC. She was also residing with William Davis in 1870. Gabriel P, Rice died in Graham County on 23 May 1903 and is buried at the Rice Cemetery. I'm not sure when Mary Mitchell Rice died, but she was still living as of 1900. Mary Jane Davis was born 29 Sep 1844 (per Bible record) in Yancey Co, NC (now Avery Co, NC). She may have been named, in part, after her Aunt Mary Davis. Mary was with her parents for the 1850 census in Yancey Co, NC, and the 1860 census in Cherokee County. In 1860, her first cousin, and future husband, John Cody, was residing with the family. Mary Jane Davis married John A. Cody on 1 Oct 1865 in Cherokee (now Graham) Co, NC. (marriage date from Family Bible). John Cody was born 4 Jul 1840 in Buncombe (now Madison) Co, NC, a son (I believe) of Godfrey Cody and Caroline Davis (Mary Jane's aunt). The Cody family was listed on the 1870 census in Cherokee County, just a few houses from her Uncle Jacob Davis.

I don't have this listing typed up yet. The Family Bible record shows that Mary died on 25 May 1886, though only 41, she outlived all of her siblings. She is buried at the Old Mother Cemetery with a marker reading "Mary Jane Cody, wife of J. A. Cody", 29 Sep 1844 - 25 May 1886. John Cody married Nancy Rice on 4 Jul 1889 in Graham County. She was a daughter of Noah W. Rice and Margaret Elizabeth Colvard. John and Nancy were listed in Graham County for the 1900 census. I don't have it typed up yet. John died on 11 Jan 1923 in Graham County, and is buried at the Old Mother Cemetery, with a marker that reads "John A. Cody" 4 Jul 1840 - 11 Jan 1923. I don't know when Nancy Rice Cody died. Jacob P. Davis was born 22 Sep 1847 (per Bible record) in Yancey Co, NC (now Avery Co, NC). He may have been named for his Uncle Jacob Davis. I'm not sure what the "P" middle initial could be fore. Jacob was home with his parents in 1850 Yancey County census, and 1860 Cherokee County census. The Family Bible record shows Jacob died on 15 Oct 1864. This may have been directly related to the Civil War. Thomas W. Davis was born 24 Jan 1851 (per Bible record) in Yancey Co, NC (now Avery Co, NC). He was probably named for his Uncle Thomas Davis. I don't know what the "W" middle initial might be for. Thomas was home with his parents in 1850 Yancey County and 1860 Cherokee County census. The Family Bible record shows Thomas died on 15 Oct 1862. This may have been directly related to the Civil War, though Thomas was only 11 then, so certainly not a soldier. He is probably buried at the Old Mother Cemetery in Lot # 67 in an unmarked grave. Nancy Matilda Davis was born 11 Aug 1853 and died just 2 months later on 24 Oct 1853 (both dates per Bible record).
