I (Marty Grant) am a 4th Great Grand nephew of Jacob Stuart.
Special thanks to Lawrence Wood (deceased) and Carl H. Stewart for data shared on this family. Also thanks to Carol Taylor, Barbara Ledford and Mitch Watson and others who were helpful as well. Check out the Stewart Researcher page for the names of other people researching this family.
Jacob Stuart (sometimes spelled Stewart) was born ca 1774/1775 in North Carolina. His county of birth is reported in two different records as being two different places. On the 1850 Macon Co, NC census, Jacob Stuart, age 75 is listed as being born in Cabarrus Co, NC. That would put him there ca 1775, however, there was no Cabarrus County at that time, as it was still part of Mecklenburg. However, this isn't a problem, as he undoubtedly knew that the section they lived in later became Cabarrus. The 1860 Macon Co, NC census gives Jacob Steward age 86 and born in Guilford County, NC. Since in both cases, Jacob was residing with his son-in-law Abraham Moore, it can be assumed that in one instance, Moore gave the census taker the information and got it wrong (or some other member of the household did), instead of Jacob himself reporting it. The problem is, which record is correct? Other evidence shows this family did live in Cabarrus Co, NC in the 1790's, so it is possible they had been in that region since the 1770's when Jacob was born. However, Guilford records should be checked as well, and so far, I haven't done so.
So, for now, I am listing Jacob Stuart as being born in Mecklenburg Co, NC (now Cabarrus Co, NC) circa 1774/75.
Jacob Stuart is almost certainly a son of John Stewart (1730/40) and Mary Ann ---, though that isn't totally proven, but I am quite confident that it is correct. John was in Cabarrus Co, NC in the 1790's and for the 1800 census (where Jacob was supposedly born), and John and Mary Ann were founding members of Newfound Baptist Church in Buncombe Co, NC in 1803, and Jacob received a land grant on Newfound Creek in 1812. On the 1820 and 1830 census (in two different counties), Jacob was listed next door to John and Mary Ann. All of this is circumstantial evidence, but it is strong circumstantial evidence. ** Update: DNA tests show that a descendant of Jacob Stewart is an exact match for descendants of Noah Stewart (1785). This proves that Noah and Jacob are of the same family. It does not exactly prove they are brothers, but it shows they are very closely related and have a common ancestor. See the Stewart DNA project for more information.
Jacob Stuart was apparently home with his parents for the 1800 census in Cabarrus Co, NC, or at least they had a male child with them aged 16 to 25, or born ca 1774/1784. Jacob fits in that category nicely.
We know that John and Mary Ann moved to the Newfound Creek area of Buncombe County, NC by 1803 where they were listed as founding members of the Newfound Baptist Church. However, Jacob was not on that church list, so apparently he didn't go with them to Buncombe right away. He was about 27 years old then, and apparently stayed behind in Cabarrus Co, NC at least another year or so.
On 11 Jul 1804, Jacob Steward obtained a marriage bond in Cabarrus County to marry Peggy Carroll. ("Peggy" is a nickname for Margaret). I am not 100% certain that this is the same Jacob Stuart, but so far I have not been able to find any other Jacob Stuart that it could be. Family Tradition among Jacob's descendants state that his wife was named Elizabeth Setzer, but no contemporary evidence has been found showing his marriage to her, or her being his wife. A family Bible record of one of Jacob's great granddaughters (a child of Ruth Jane Stewart 1850-1946) states that Jacob's wife was Elizabeth Setzer. This was written long after the death of Jacob's wife, but it could still be accurate. It wasn't written by Ruth (1850), but by one of her daughters, so that puts it long after the death of Jacob (d 1863). I suspect that Margaret "Peggy" Carroll died sometime shortly after marriage in 1804, and that Jacob soon married Elizabeth Setzer, though no marriage record has been located (if it was in Buncombe County, there would be no record, as all the early marriage records were lost for that county).
It isn't clear where Jacob could have met Elizabeth Setzer. As far as I've been able to tell, Jacob never lived in a county where Setzer families also lived, at least not until the 1820's when he moved to what is now Macon Co, NC. Interestingly, there were at least two marriages in Macon Co, NC between members of the Setzer family and Carroll family. Both were daughters of John Setzer and Catherine Tarr; Rue and Mary Setzer, who married Miles and Daniel Carroll, both sons of William Carroll and Millie Moore.
Lawrence Wood told me that he was never able to find a place for "Elizabeth Setzer" in the Setzer family, and that he had researched the Setzer line for years.
The 1800 census shows a William Carroll in Cabarrus Co, NC, but no Setzer families. There was a John Carroll family in Buncombe Co, NC already by 1800, though I don't know if he had ties to Cabarrus Co, NC or not.
On the 1800 census, I found Setzer families (with various spellings) in Burke, Lincoln and Rowan Co, NC, but none in the area where Jacob Stuart lived.
Jacob Stuart and his wife (whichever one it was at the time) moved to Buncombe Co, NC sometime after 1804, but before 1810. He was listed there on the 1810 census, apparently in the Newfound Creek area where his father had been, but for some reason, his father was over the county line into Haywood County in 1810, but probably not very far from Jacob.
1810 census analysis (based on available evidence): (Explanation of this census)

Now, for the 1810 census, there were several Carroll families in Buncombe County. The William Carroll who had been in Cabarrus in 1800 was no longer there. As far as the Setzer family goes, none were in Buncombe Co, NC (nor Cabarrus), but there were several in Lincoln Co, NC in 1810.
In the early part of 1812, Jacob Stuart must have moved to neighboring Burke County, NC for his son John Stuart was born in Burke Co, NC (per the 1850 Macon Co, NC census) on 19 Jun 1812. This may have something to do with the Setzer family as their had been an Adam Setzer residing in Burke Co, NC in 1800. I didn't find him there in 1810 though, but this might be part of Elizabeth Setzer's family. This may also indicate that Margaret Carroll died shortly after 1810, and that Jacob married Elizabeth Setzer between 1810 and 1812. This would mean that the older children were Margaret's, and the rest Elizabeth's. I'm not prepared to divide up the children just yet though, as this is just speculation.
On 10 Dec 1812 Jacob Stewart received a State land grant for 150 acres on Newfound Creek in Buncombe Co, NC. This is the same region where his father had lived before (and apparently came back to around this time). (Buncombe Co, NC Deed Book S1-6 page 218).
Jacob Stuart was still in Buncombe Co, NC for the 1820 census, and was listed next door to his parents (I believe it was them, but can't be sure as the first name was obscured). They are probably living on the Newfound Creek property. As before, there were no Setzer's in Buncombe County or nearby, but several Carroll families were in the region, just one in Buncombe, but two in neighboring Haywood County.

On 6 Feb 1822 Jacob Steward sold his 150 acres on Newfound Creek to David Cole. This probably signified their move to what is now Macon Co, NC. (Buncombe Co, NC Deed Book 13 page 227).
Sometime after selling their Buncombe County land, Jacob and family, and his parents John and Mary Ann, moved to the south western region of then Haywood County. This area later became Macon County, NC.
In 1828, Jacob Steward and many others signed a Petition requesting that Macon County be formed. This petition was also a census of residents in that area. Jacob was listed with 1 male over 21 (himself), 1 male under 21 (his son John-1812), 2 females (wife Elizabeth and a daughter), and no slaves.
Jacob Stuart was listed on the 1830 census in Macon Co, NC, and was next door to his parents. Two of his married children were next to him as well.

Jacob Stuart was a voter in the 1835 Congressional elections. He was listed as Jacob Steward and voted in the Valleytown Precinct, which means he had moved into the western part of Macon County, in the area that soon became Cherokee County, NC.
Elizabeth Setzer Stuart died sometime between 1830 and 1840, possibly in Cherokee Co, NC or in Macon.
Jacob Stuart was listed on the 1840 census in Cherokee Co, NC (formed 1839 from Macon). In 1840, Christopher Setzer was listed on the same page as Jacob, a few households away. Jacob's son-in-law Thomas Postell was also listed in Cherokee Co, NC, but not on the same page. Two young children were with Jacob in 1840, perhaps grandkids, or a niece and nephew.

By 1850 Jacob Stewart had gone back to Macon Co, NC and was residing with his daughter Lydia and her husband Abraham Moore:

Jacob Stewart died 6 Feb 1863 in Macon Co, NC. I don't know where he is buried, or if his grave is marked.
From what I can tell, Jacob Stuart never owned land in Macon Co, NC, but he generally seemed to live in the area of Ellijay Creek.
The before mentioned Bible record from Ruth Jane Stewart's daughter's bible tells a good bit about this family, but seems to contain some questionable data. Here is the Bible record in full, as shared with me by Carl Stewart. The original is in the possession of Mitch Watson. Spelling is as it was originally. This document also contains information on the Moss family. Apparently, this Bible belonged to Ruth Jane Stewart (1850), but the entries below were written by her daughter, so this was well after the fact for Jacob Stewart's family, so their may be inaccuracies in that part, but the more recent data is probably more reliable. I suspect this was written no early than ca 1880, so consider that when judging the accuracy of everything. (Anything in parenthesis (...) was added by me, Marty Grant, as a comment).

There may have been more to the bible record, but this is all that was shared with me.
Jacob Stuart had several children. The Family Bible record of his granddaughter Ruth Jane Stewart (1850-1946) (though the record was written by Ruth's daughter, so even more recent). This was shared with me by Carl H. Stewart, shows Jacob with 3 sons and several daughters. This record was undoubtedly written down after Jacob's death in 1863, and some of it seems pretty accurate, but not all of it. For instance, the 1810, 1820, 1830 and 1840 census records show that Jacob only had one son. If he had others, they were born and died between census years, or else were raised by someone else (if they were from his first wife Margaret Carroll, then they may have been raised by maternal grandparents after her death). The Bible record also does not mention Mary Stewart who married Thomas Postell, who is a proven daughter of Jacob.
Mary "Polly" Stewart (1804/10-c1849)
Mary "Polly" Stewart was born ca 1804/1810, presumably in Buncombe Co, NC, though possibly in Cabarrus County. She might be a child of Jacob's first wife Margaret Carroll. She is a proven daughter of Jacob Stuart.
The Ruth Jane Stewart (1850-1946) Family Bible record lists several children of Jacob and Elizabeth, but does not include Mary. Since Mary is proven by other sources, it can probably be concluded that since Mary died in the 1830's (long before Ruth Jane was born), that she didn't know about her, or else just forgot when making her Bible entries (further proof that the Bible entries were made long after the events recorded).
Mary was apparently home with her parents for the 1810 and 1820 census, or a girl her age was with them.
On 6 Aug 1822, Thomas Postell obtained a marriage bond in Haywood Co, NC to marry Polly Sturd. The bond listed her as a daughter of Jacob Sturd. They were in the region of Haywood County that became Macon County in 1828.
Thomas Postell (listed as Thomas T. Postell on other records) was listed on the 1830 census in Macon Co, NC next to his brother-in-law Abraham Moore, who was next to John and Mary Ann Stuart (grandparents), who was next to Jacob Stuart, so they all were neighbors.

Mary Stewart Postell died sometime after 1832, but before ca 1837. Thomas T. Postell married Lucinda --- as his 2nd wife sometime before 1837.
By 1840 the Postell family had moved to neighboring Cherokee Co, NC, as did Mary's father Jacob Stuart. They were both listed on the 1840 census in Cherokee Co, NC, though not on the same page. I don't know if they were in the same region of the county or not.

Thomas Postell and his 2nd wife and their children, were listed on the 1850 census in Cherokee Co, NC. I don't have this typed up yet. Ron Long, a descendant of Thomas Postell, has shared some information on this family with me.
Lydia Stewart was born 14 Jan 1807 in Buncombe Co, NC (per the 1850 census, or Haywood Co, NC per the 1860 census). Lydia was named in the Ruth Jane Stewart (1850-1946) Family Bible as a child of Jacob and Elizabeth Stewart. Also, Jacob Stuart lived out his elder years with his daughter Lydia (as proven by the 1850 and 1860 census records), so that seems fairly conclusive that she is his child. I am not sure if Lydia is from the Carroll marriage or the Setzer marriage.
Lydia was apparently home with her parents for the 1810 and 1820 census. Lydia married Abraham Moore sometime before 1827 in Haywood Co, NC (now Macon Co, NC). No marriage record was found for them in the Haywood marriages, which are extant for this period.
Abraham Moore was born 27 Dec 1807 in Buncombe Co, NC, a son of John Parker Moore (1765-c1856/60) and Millie Redmond (c1765-1840/50).
Abraham Moore, like his father-in-law Jacob Stuart, signed the 1828 petition asking for the creation of Macon County from the southwestern part of Haywood. Abraham was listed with 1 white male over 21 (himself), 1 white male under 21 (son Andrew Moore-1827), and 1 white female (wife Lydia) and no slaves.
Abraham Moore was listed on the 1830 census in Macon Co, NC next door to his brother-in-law Thomas Postell, and next to his grandparents-in-law John and Mary Ann Stuart, who were next to Jacob Stuart.
Like his father-in-law Jacob Stuart, Abraham Moore moved to what is now Cherokee Co, NC in the early 1830's. He was listed on the 1835 Congressional Voter List in Macon Co, NC in Valleytown Precinct. Cherokee County was created in 1839 from this section of Macon, but it seems that he had moved back to the Ellijay Creek region (where he had been before) by then.
Abraham Moore was listed on the August 1839 Macon Co, NC Court Records on the Insolvent list (unpaid taxes). He was listed with 156 acres and 1 poll. (Macon Co, NC Court Minutes 1838-1855 pg 34)
Abraham Moore was listed on the 1840 census in Macon Co, NC. He seemed to be in the area around Burnington or Iotla Creek (based on his neighbors names), and this is far from Ellijay Creek, in fact on the other end of the county. He may have resided in that area briefly, or perhaps this is just a result of the census records getting out of order when taken originally.

Lawrence Wood (deceased), provided me with a great deal of information about this family, including many birth and death dates. His data shows that Lydia Stewart Moore died on 23 Sep 1878 and Abraham Moore died 15 Dec 1881, both in Macon Co, NC. In the Ruth Jane Stewart Family Bible, she names Jackson Moore who married "Kate Holbrooks", and Peg Henry, wife of John T. Henry; and "another woman who married a Black Burn man", (that would be Angeline Moore who married J.C. Blackburn). Abraham and Lydia had nine children, and not all were mentioned in Ruth's Bible record.
John Stuart was born 19 Jun 1812 in Burke Co, NC (birth place per the Macon Co, NC 1850 census). John spelled his name "Stuart" on most records, though "Stewart" showed up on a few. Descendants of John tell me that his nickname was "Choga".
John Stuart was apparently with his parents for the 1820 and 1830 census.
John Stewart obtained a marriage bond in Macon Co, NC on 14 Jun 1831 to marry Mary Moss. Lawrence Wood told me that Mary was a child of William Henry Moss and Elizabeth Hooper.
John Stuart voted in the 1835 Congressional elections, and was listed on the voter list in Macon Co, NC in Fairfield Precinct.
John Stuart was listed on the 1840 census in Macon Co, NC. He was next door to his father-in-law William Moss. They were apparently in the Hamburg region of Macon Co, NC, based on their neighbors.

On 28 Jan 1845 John Stuart received a state land grant of 50 acres on White Pine Creek. He entered (claimed) the land on 9 Sep 1842. (Macon Co, NC Deed Book E page 359).
In September 1845, in Macon Court, John Stuart was one of several named to work under Jesse Cline on a road crew. (Macon Co, NC Court Minutes 1838-1855 pg 3)
John Stuart was listed on the 1850 census in Macon Co, NC, in Hamburg District. His father-in-law was next door, or two houses away.

This section of Macon County became Jackson County when that county was formed in 1851. He wasn't far at all from his father Jacob, but now in a different county.
I haven't done much research on the family in Jackson County, I did note that John Stuart is listed on the 1860 census there, but I don't have that listing yet.
Mary Moss Stuart died on 28 Jul 1859 in Jackson Co, NC.
John Stuart remarried ca 1860 to Lucinda Owens, presumably in Jackson County.
John Stuart died on 13 Apr 1895 in Hamburg, Jackson Co, NC. I don't have a death date for Lucinda yet.
Lawrence Wood shared the names and birth and death dates of John Stuart's family.
Stacy Stewart was born ca 1814/15, presumably in Buncombe Co, NC. I had no record of Stacy being a child of Jacob until Carl H. Stewart shared the Ruth Jane Stewart Family Bible Record with me. In it she mentions among the children of Jacob and Elizabeth, one "Stacy Stewart who married Buck Colbert who died, later she married J. David Moss".
There was a Stacy Stewart listed on the 1850 census in Cherokee Co, NC. She was 35 (born ca 1814/15) so this is a perfect match for the daughter (1810/15) of Jacob who was with him in 1820 and 1830. This Stacy had several children with her in 1850, giving her the appearance of a widow with children, or a single mother. I've had this Stacy Stewart in my records for years, but didn't know if she was a widow, or to what family she belonged. The Ruth Jane Stewart Bible record may help figure her out, if she is the same Stacy Stewart referred to there, and I'm almost positive that she is the same.

The Bible record says she married "Buck Colbert". "Colbert" is probably Colvard, and "Buck" is probably a nickname, or middle name. Since she was listed as a "Stewart" in 1850, she must have married Buck afterwards. She was listed as a Moss on the 1860 census. The children listed with her are very close in age to those with Jacob Stuart on the 1840 census, so could these be the Moss children I speculated about (possible children of Sally Stewart Moss).
Stacy Moss was found on the 1860 census in Cherokee Co, NC with a child Margaret residing with her (see below). I think this confirms that this Stacy is the same one who is a child of Jacob Stuart. This means she married Buck Colvard after 1850, who died, then she married J. David Moss after that, all before 1860.
The children with Stacy in 1850 were listed as Stewarts, but in 1860 they (two of them anyway) were listed as Moss. This may mean I am correct about them being Sally and Milton Moss' children. If this is true, they were being raised by their Aunt Stacy. Otherwise, they may be her own children, though I can't account for all being listed as Stewart in 1850, and Moss afterwards (this is a common occurrence among out of wedlock births, a shuffling of surnames). Whether or not they are Stacy's or her sister Sally's, here is what I know about them:
The oldest child with Stacy in 1850 is "Felix" age 19 (born ca 1830/31). Although he is listed as a Stewart, I suspect he is actually a Moss. On the 1860 census, in Cherokee Co, NC is a listing for A. N. Colvard and wife Mira R. Colvard. With them is a Felix N. Moss age 28. This supports my theory, as I feel strongly this is the same person, and probably a child of Sally Stewart and Milton Moss. It is also possible that he was Stacy's child, if she were having children out of wedlock. A. N. Colvard is probably a relative of "Buck" Colvard.
The next child with Stacy in 1850 was Margaret age 17 (born ca 1832/33). She is probably a Moss as well. She was with her mother still for the 1860 census, and listed as a Moss.
The last child with Stacy in 1850 was Mary J age 4 (born ca 1845/46). She is way too young to be one of Sally's children, so might not be a Moss.
Jehu (Jayhue) Stewart. I had no record of this child until Carl H. Stewart shared the Ruth Jane Stewart Family Bible Record with me. In it she mentions among the children of Jacob and Elizabeth, one "Jayhue Stewart who left and went to Georgia no one know where".
The 1810 census record for Jacob Stuart shows no sons. In 1820, he had only one son listed, a boy under age 10 (born ca 1810-1820), which had to be John Stuart-1812. In 1830 Jacob still only had one son with him, a boy age 15-19 (born ca 1810-1815), which still had to be John Stuart born 1812. In 1840 Jacob only had one boy age 5-9 (born 1830/35) with him, who must have been a grandson. In other words, none of the census records have room for Jehu Stewart.
Perhaps Jehu was a child of Jacob and his first wife Margaret Carroll, and after her death, he went to live with his maternal grandparents (the Carroll family), as was often the custom. This would explain his apparent absence from Jacob Stuart's census records 1810 through 1830.
According to Ruth Jane Davis, Jehu went to "Georgia", and she didn't know where. I did not find a "Jehu" (or any other spelling) Stewart in 1850 Georgia census records, nor did I find him in 1860 in any state (there was one in Pennsylvania, but that probably isn't him).
Prealo Stewart. I had no record of this child until Carl H. Stewart shared the Ruth Jane Stewart Family Bible Record with me. In it she mentions among the children of Jacob and Elizabeth, one "Prealo Stewart who died between the age of 15 and 20 years of age".
In other words, none of the census records have room for Prealo Stewart.
Perhaps, as I speculated about Jehu, Prealo was a child of Jacob and his first wife Margaret Carroll, and after her death, he went to live with his maternal grandparents (the Carroll family), as was often the custom. This would explain his apparent absence from Jacob Stuart's census records 1810 through 1830.
If Prealo died as a teenager, that would also explain his lack of entry on other records.
Sally Stewart. I had no record of this child until Carl H. Stewart shared the Ruth Jane Stewart Family Bible Record with me. In it she mentions among the children of Jacob and Elizabeth, one "Sallie Stewart who married Milten Moss".
Jacob Stuart's 1810, 1820 and 1830 census records do not leave any room for Sally Stewart or any extra daughter, besides those named above. It is possible that she was (as I speculated about Jehu) a child of Jacob's 1st wife and raised by someone else. Just speculation though.
There was no marriage record for Milton Moss and Sally Stewart in Macon Co, NC, but there was a marriage record for Milton Moss and Ruth Peak in 1836. If this is the same Milton Moss, then apparently Sally Stewart was his first wife, and she died before 1836.
Milton Moss and Ruth and their family were listed next to John Stuart in 1850 Macon Co, NC. None of their children predated Milton and Ruth's 1836 marriage, so if this is the same guy who married Sally Stewart, they had no children, or else they were living with someone else.
Jacob Stuart had a two small children with him in 1840, one boy age 5-9 (c1830/35) and a girl under 5 (c1835/40). These could have been Sally's children. Their ages are agreeable with a ca 1830 marriage, and a death date for Sally before 1836. However, this is just speculation on my part.
If Sally Stewart was not the daughter born ca 1810/15 with Jacob in 1820 and 1830, then she may be (as I speculated for Jehu and Prealo) a child by the first marriage and raised by grandparents, or someone else. All just speculation though.
