John Stewart (1730/40) and Mary Ann of Mecklenburg, Cabarrus, Buncombe, Haywood and Macon Co, NC

I (Marty Grant) am a 5th Great Grandson of John and Mary Ann Stewart. I am descended from them three different ways.

John Stewart (just as often spelled "Stuart") was born ca 1730/1740, whereabouts unknown. He was in North Carolina for many years, but it seems more likely that he was born elsewhere, such as Virginia or Pennsylvania, or possibly even in Scotland or Ireland. Unfortunately we have no evidence indicating where he was born. In some branches of the family (still carrying the Stewart name) there is a strong tradition of Scottish origin. That doesn't mean John himself was born in Scotland, but perhaps his parents were.

We don't have a record of John's early life, in fact, the first we know of him (from public records, anyway) was from the 1790's. That leaves many years unaccounted for.

John Stewart married Mary Ann --- sometime before ca 1775. So far, I've found no clues at all as to what Mary Ann's maiden name was. We don't know where this marriage took place. Their suspected son Jacob Stuart reported in 1850 (Macon Co, NC 1850 census) that he was born in Cabarrus Co, NC and that he was 75 years old. If this is correct, that puts John and family in Cabarrus Co, NC ca 1775. At that time, Cabarrus did not exist, and was still a part of Mecklenburg County. However, to confuse matters, Jacob reported his birth place in 1860 as "Guilford" Co, NC (Macon Co, NC 1860 census), and gave his age as 86, or born ca 1773/74. Since in both cases, Jacob was residing with his son-in-law and his daughter, it is quite possible that in one of these instances, he gave the information, and in the other case, someone else told the census taker the wrong thing. The trouble is, which is correct?

So, that means that John and Mary Ann may have resided n Guilford Co, NC and/or Cabarrus Co, NC (then Mecklenburg) in the 1770's. I have not checked Guilford Co, NC records to see if a John Stewart was found there at that time. 

One problem I've encountered, is that "John Stewart" is a very common name, and there were men of this name in many early NC records, and in the proper time frame, and some with a wife named "Mary". 

The 1790 census shows a John Steward in Rutherford Co, NC. This part of Rutherford was in the section that became Buncombe County in 1792, so it seems reasonable (but unproven) that this is our John Stewart. This could be someone else entirely, but there is much about this entry that fits our John, and nothing about it to make it unlikely.

On 13 Jan 1794 John "Steward" purchased 100 acres of land on the Little River from Gilliaham Harris, in Buncombe Co, NC. Little River rises in southern Transylvania County just on the South Carolina line, and flows generally northward into the French Broad River. Its entire course is within present Transylvania County, but at that time (1794) this was all Buncombe County. I have found no record of John selling this land. (Buncombe Co, NC Deed Book 3 page 33).

It isn't clear, or completely proven yet, but it seems that John Stewart and family were also in the Cabarrus County, NC area at this same time. There are records in Mecklenburg and Cabarrus (formed 1792 from Mecklenburg) that seem to refer to this John Stewart. John's son Jacob Stewart (born 1775) reported in the 1850 Macon Co, NC census, that he was 75 years old and born in Cabarrus Co, NC (c1775). However, the 1860 Macon Co, NC census reports the same Jacob as being 86 years old (c1774) and born in Guilford County, NC. These two conflicting places of birth seem to confirm at least that the family was somehow connected with Cabarrus County. There may also be a Guilford County connection.

The 1800 census shows no John Stewart anywhere in or near Buncombe County, NC. There is also no record of John "Steward" selling his land there. I personally believe that around this time (1790's) John and family went back to Cabarrus County for some reason. Perhaps the Little River area was too much of the frontier for them. John and Mary Ann's daughter Emelia married Michael Waters in Cabarrus in the early 1790's (no record found). Michael Waters was listed on the 1800 census in Cabarrus County just two pages from John Stewart.

The 1800 census shows John Stuart as the only Stewart in Cabarrus County. Two pages away was his son-in-law Michael Waters, who also later moved to Haywood and Macon County, NC. This fact seems to help cement the identity of this John Stewart as being the same one under study here (but not helping determine if the one in 1790 Rutherford and 1794 Buncombe is the same one or not).

Cabarrus County Court records show a John Stewart called for jury duty in July 1795 and October 1796. A William Stewart was called in January 1794, and July 1794.

On 28 Feb 1791 William Stewart and wife Jean, of Mecklenburg County sold 124 acres of land on Andersons Creek to John Stewart of Mecklenburg County. In 1791 Andersons Creek was still in Mecklenburg, but when Cabarrus was formed in 1792, it fell into the new county.  William Stewart was a son of Thomas Stewart who died 1778 in Mecklenburg Co, NC. Thomas also had a son John, but I get the impression that Thomas Stewart was about the same age as our John, couldn't be his father (but could be his brother, but no proof so far). William Stewart (with wife Jean) who sold land to John Stewart in 1791 was born ca 1755/1774 per the 1800 census. That makes him much younger than our John.

On 19 Jan 1797 John Stewart was named in the Court minutes for Cabarrus Co, NC as being part of a jury to lay out a road from Charlotte to Fayetteville through the lower part of the county from the Mecklenburg line.

We have no direct proof that John Stewart in Buncombe County in the 1790's was the same John Stewart we are looking for. That could be a different John who moved in there (before 1790) and then moved on further west (before 1800).

The John Stewart in Cabarrus is ours, I'm fairly sure, but I have no comprehensive proof of that. Like I mentioned before, he left us very few records.

If the John Stewart in 1800 Cabarrus was ours, then he moved to (or back to) Buncombe County by 1803, for in that year he was listed as a founding member of the Newfound Baptist Church (listed as John Stuard). Newfound Creek is in the section of Buncombe County very close to the Haywood County line. Newfound mountain is part of the boundary.

On 18 Dec 1806 John Stewart purchased 200 acres of land on Rocky Branch, Waters of French Broad River from William Young. Witnesses were William Bryson (William Young's father-in-law) and Elizabeth Watkins.  (Buncombe Co, NC Deed Book B page 188).

I haven't found "Rocky Branch" yet, but it may have been within the bounds of Haywood County, which was created from Buncombe in 1808.

The 1810 census shows John Stewart, John Stewart (Jr) and Noah Stewart all in Haywood County. All three are spelled "Stuart" on this census. This census is alphabetized, so you can't tell if the three were neighbors or not. This census shows that all of John and Mary's children were grown and gone from home by this time.

I haven't exhausted the Haywood and Buncombe County records yet for the Stewarts, so there may be lots of data waiting to be found there. I have thoroughly checked the deeds and early census records though.

In the 1820 census neither Noah Stewart, John Stewart or John Stewart (Jr) were found. Noah was back in Haywood by 1830, so there is no telling where he was in 1820. It is quite possible he moved to East TN for a short time, and then came back. John Stewart (Jr) may have done the same, but didn't come back. Their brother Jacob (1775) was listed in 1820 Buncombe Co, NC on page 68. Just one household away was another Stewart (listed as "Stuart") who's first name had been smudged and was totally illegible. The family only included one male over 45 and one female same age. I'm 99% sure this is our John Stewart.

During the mid 1820's John Stewart (1730/40) and his son Jacob (1775) moved to what is now Macon County, NC, but was then western Haywood County. John and his wife Mary Ann were listed as members of the First Baptist Church in Macon Co, NC from 1826 through 1830 for John, and Mary Ann 1826 through 1835. In 1828 Jacob Stewart signed the petition asking for the formation of Macon County. The 1830 census doesn't show John Stewart in Macon County, but his wife Mary Ann is listed as head of household as "Merian Stuart". She was listed as age 80-89 or born 1740/50. There was a man with her age 90-99 (born 1730/40) which was undoubtedly her husband John Stewart. He must have been in very poor health (mentally or physically), or else he would have been listed as head of household. 1830 was the last year he was shown as a member of the First Baptist church, so it seems he died later that year. I have Mary Ann listed on the church register up through 1835, and probably after that (I didn't go beyond that year). She was not found on the 1840 census, but apparently still alive then.

For the 1830 census, Mary Ann Stewart (Merian Stuart) was listed in Macon Co, NC, and was listed between her son Jacob Stuart, and her grandson-in-law Abraham Moore (married to Lydia, daughter of Jacob Stuart). And next to the Moore family was Thomas Postell, who married another of Jacob's daughters (Mary).

John Stuart died sometime within the year 1830 most likely. His last entry on the church register was for that year. Mary Ann was listed through 1835, and probably beyond that, but I stopped at 1835.

I did not find Mary Ann Stuart listed on the 1840 census, but she might have still been living then. If so, she was with a son or daughter, or with a grandchild. I checked the 1840 census entries (those that have been located) for each of their children and grandchildren, to see if anyone had a woman in her 90's residing with them. I didn't find any of them with someone her age.

In the January 1842 session of Macon County, NC Court, Eli Collins was given an allowance for keeping Mary "Stuart". The court record doesn't indicate if this was past tense or if he was currently keeping her. Eli Collins' wife Lydia Waters, was a granddaughter of John Stewart and Mary Ann. This seems to show that she spent her final years with granddaughter Lydia Waters Collins.

The 1842 record is the last I have for either John or Mary Ann. She was not found on the 1850 census.

The family used various spellings of their name, as many Stewarts did in those days, so don't worry about whether it was "Stewart", "Stuart", or something else. It really depended on who was writing it down.

My personal belief (subject to change!) is that our John Stewart (1730/40) is somehow related to Thomas Stewart of Mecklenburg County, NC who died in 1778. Thomas' wife was Catherine, and their children were: William (1755/74), Thomas (1760), Agness, Olivia (1762, m 1794 James Callen), Mary, Elizabeth, John, and Ann.  He owned land on Anderson Creek in (now) Cabarrus County, and since his children were born in the 1750's, 1760's etc Thomas could easily have been born in the 1730/40 timeframe just as our John was. Them being brothers sounds good, but more evidence would be needed. Thomas was from Cumberland Co, PA. Thanks to Joyce McMurray for some of the data on the Thomas Stewart family. Apparently Thomas family was still in PA in the 1760's. Perhaps our John was there as well.

 


Children

None of the children of John and Mary Ann Stuart are completely proven, but at least two of them seem irrefutable (Jacob and Emelia). The rest are included here based on various bits of circumstantial evidence. A Family Bible record (written by Jacob's Great Granddaughter long after the death of Jacob) lists a "Ruthie Stewart" as sister of Jacob.  Recent DNA testing proves that Jacob Stewart (1775) and Noah Stewart (1786) are closely related, as we have long suspected, but could not prove.

Emelia Stewart was born ca 1770/75, possibly in Mecklenburg Co, NC (now Cabarrus Co, NC). Emelia seem to be at home with her parents for the 1790 census (If the 1790 census entry in Rutherford Co, NC is the right family). If this was them in Rutherford (in the region that became Buncombe County shortly afterwards), then they returned home to to Anderson Creek in Cabarrus Co, NC (which had been Mecklenburg County until 1791). About this time (or between 1790 an 1794), Emelia married Michael Waters. They were still in Cabarrus for the 1800 census. They moved into Mecklenburg Co, NC before 1806, and remained there until at least 1815. Between 1815 and 1820 they moved to what is now Macon Co, NC, but was then still part of Haywood County. Michael Waters died between 1838 and 1840 in Macon Co, NC. Emelia was listed as head of household for the 1840 census, but died before 1850. They named their eldest son "John Stewart Waters", probably after her father. Emelia's son-in-law Eli Collins (who married Lydia Waters) maintained his grandmother Mary Ann -- Stewart in her old age, so this is all strong evidence for Emelia belonging to this family. These are my ancestors, and in my years of Waters research, I never found anything about Emelia being a Stewart, nor any indication of her maiden name. However, thanks to certain discoveries that I made, and information received from Jane Driver around the same time, we are now certain she was a Stewart, and that she was a child of John and Mary Ann.

Unknown Son (1774/84) John and Mary Ann had an apparent son born ca 1774/1784 with them for the 1800 census (Cabarrus Co, NC). When they moved to Haywood Co, NC, they were listed on the 1810 census there. They had no children with them then, so this son had married, died, or just moved out by then. It is possible that this is the same person as their suspected son John Stuart, but he was married in 1795, and probably wasn't with them still in 1800, though he could have been living with his folks still then.

Whomever this son was, he probably married in the 1800-1810 timeframe. There was a marriage bond in Cabarrus Co, NC dated 24 Mar 1808 between James Stewart and Nancy Kielough. The John Stuart family was already out of Cabarrus before 1808, but that wouldn't necessarily stop one of his sons from going back there to get married. I found a James Stewart listed on the 1810 census in Mecklenburg Co, NC, one in Anson Co, NC and one in Buncombe. The one in Buncombe is not this same James who married in Cabarrus. I don't know about the one in Mecklenburg and the one in Anson Co, NC though. 

I suspect the one in Mecklenburg County was the one, but more research is needed to be sure.

In any event, James Stewart died before 1820, as his widow Nancy was listed back in Cabarrus Co, NC for the 1820 census, and near several members of the Kielough family. 

I don't know if James is a son of John and Mary Ann Stuart or not, but he could be. More research is needed to see if this is the case or not.


John Stuart (1765/84).  John Stuart (Jr) was born ca 1765/1784. I don't have any direct evidence that he was a child of John and Mary Ann, but when John (Sr) moved to Haywood Co, NC by 1810, he was listed there near another John Stuart, who was born ca 1765/84 per that census. Unfortunately, that census was alphabetical, so we can't determine if they lived near each other, but it seems reasonable that this other John was a child of John and Mary Ann. 

John Stuart obtained  marriage bond in Cabarrus Co, NC on 25 Sep 1795 to marry Mary Davis. It is quite possible that this couple is the John Stuart (Jr) found in 1810 Haywood Co, NC near John (Sr). It is also possible that this marriage was for some other John Stuart, as yet unidentified. One additional possibility, is that this was a marriage for John Stuart (Sr), and this "Mary Davis" was the same person as "Mary Ann ---", wife of John Sr. If so, then she would have to be his second wife, as all of their known children were born before 1795. Whether this is a marriage for John Sr, Jr or some other John, I can't say with any certainty. 

If the 1795 marriage was for John Stuart (Jr), then he should have been listed on the 1800 census on his own, but I didn't find him anywhere. However, John Stuart (Sr) had a male about his age with him (unknown son 1774/84), and at two girls born in the 1790-1800 timeframe. These could be John Jr and his wife and two children, or not. John (Jr) may have been residing with his Davis in-laws, or he may have just been missed in 1800.

For the 1810 census, John Stuart (Jr) was listed in Haywood Co, NC, as was his supposed father John Sr, and his supposed brother Noah Stewart. Unfortunately this census was alphabetical, so we don't know how close they lived to one another. I do believe they all lived in the area of Hominy Creek, which borders Buncombe County, where his suspected brother Jacob Stuart was residing then. They were probably all within 5 miles of each other. John (Sr) and John (Jr) were listed on the same page, though neither used "Sr" or "Jr" on this record. The ages of John's children in this census strongly support a 1795 marriage, so that helps the case for this being the same John who married Mary Davis in 1795.

By 1820 John (Sr) had moved the short distance into Buncombe County and was there next to his other son Jacob Stuart. John Sr's supposed sons Noah and John (Jr) were not found in NC on the 1820 census. Though Noah was back in Haywood by 1830, I found no further record of John (Jr). Since "John Stuart" (or Stewart) is such a common name, I can't find any strong leads on our John (Jr). The 1820 census was lost for eastern TN, and he may have moved there, as much of the Stewart family moved into that area later on. The 1830 census shows many men named John Stuart living all over the place, so no help there. Perhaps we will get lucky and find a descendant of this family, or stumble across something that helps us find where he went to.


Jacob Stuart was born ca 1774/75 in NC, either in Mecklenburg Co, NC (now Cabarrus Co, NC) or in Guilford Co, NC. Jacob is not a proven child of John and Mary Ann, but the circumstantial evidence for him being their child is strong. So strong, that I have no doubt he belongs in this family. Lawrence Wood (deceased) told me that he was sure Jacob was their child, but he had no primary evidence proving it, nor have I found any, but like him, I have no doubt that it is correct.

Jacob Stuart appeared in Buncombe Co, NC in 1810, and was living very near where his father John was, though John was over the line in Haywood County. By 1820, John Sr had moved next to Jacob in Buncombe County, and during the 1820's, they both moved to Macon Co, NC. For the 1830 census, they were again listed next door to each other, though now in Macon Co, NC.  

Jacob Stuart was married to either (or both) Elizabeth Setzer or Margaret Carroll.  See Jacob's own page for additional information about his family.


Unknown Daughter (1774/84). John and Mary Ann Stuart had an apparent daughter this age with them on the 1800 census. She was gone by 1810, so had either married or died by then, or had moved out. There were no female Stewart / Stuart marriages in Cabarrus Co, NC in the 1800-1810 timeframe, so we may possibly conclude that she married in Buncombe Co, NC (early marriage records lost for Buncombe) or in Haywood County (formed in 1808 from Buncombe), who's very early marriages are also lost. I have no clues who this daughter might be.


Unknown Son (1784/90) / Noah Stewart (1785/86). John and Mary Ann had an apparent son born ca 1784/1790 living with them in 1800. This son was gone by 1810, so had married, died or moved out by then. I have strong suspicions that this is my ancestor Noah Stewart born ca 1785/86. Lawrence Wood (deceased) told me several years ago that he believed that Noah was a brother of Jacob Stuart of Macon Co, NC, and that he had no proof to back it up, it was based on family traditions and things he had heard much of his life. 

I haven't found any direct proof to place Noah Stewart as a son of John and Mary Ann, but various bits of circumstantial evidence seem to point to it being fact. However, some primary evidence would be nice. 

Noah Stewart was listed on the 1810 census in Haywood Co, NC as was his suspected father John, and suspected brother John. Later when John (Sr) and Jacob moved to Macon Co, NC, Noah remained in Haywood, later moving to Union Co, GA in the 1840's. Noah named his oldest son "John" and his oldest daughter "Mary", and named a son "Jacob", each named, perhaps, after his parents and his older brother Jacob.

Unknown Daughter (1790/1800). John and Mary Ann Stuart had an apparent daughter this age with them on the 1800 census. She was gone by 1810, so had either married or died by then, or had moved out. There were no female Stewart / Stuart marriages in Cabarrus Co, NC in the 1800-1810 timeframe, so we may possibly conclude that she married in Buncombe Co, NC (early marriage records lost for Buncombe) or in Haywood County (formed in 1808 from Buncombe), who's very early marriages are also lost. I have no clues who this daughter might be. This could be Ruth Stewart described below.

There were no female Stewart / Stuart marriages in Cabarrus Co, NC in the 1800-1810 timeframe, so we may possibly conclude that she married in Buncombe Co, NC (early marriage records lost for Buncombe) or in Haywood County (formed in 1808 from Buncombe), who's very early marriages are also lost. I have no clues who this daughter might be.


Unknown Son.  On the 1850 census in Union Co, GA, John's suspected son Noah Stewart was listed four houses from an Elizabeth Stuart age 60. She seems to be a widow, but could be a single mother instead. This proximity to Noah makes me sure that she was closely related, possibly a sister, or widowed sister-in-law. If she is a sister of Noah, then that precludes Elizabeth Stewart (1777) below from being a sister of Noah. 

If she were a widow of a brother of Noah, then which one? There was the Unknown Son born ca 1774/84 who vanished from John's household after 1800, but before 1810. Then there was John Stuart (Jr) and then finally Jacob. We know that  Jacob had a wife (possibly a 2nd wife) named Elizabeth Setzer. Could this be her? It doesn't seem likely to me, but some have though maybe she was Jacob's wife, though why were they living apart in 1850 (Jacob was in Macon Co, NC then).

This Elizabeth had a daughter named Frances born ca 1815 in NC. I found no trace of this family on the 1820, 1830 or 1840 census. However, Frances married a Mr. Hampton sometime before 1834. They had a child born in NC ca 1835, and the next child was born in TN ca 1830. The next child was born in 1840 in TN, then the next one ca 1844 in GA, signifying a move to Union Co, GA. Presumably, Frances' mother Elizabeth was with her during all these moves. They were listed together on the 1850 census in Union Co, GA just 4 houses from Noah Stewart.

STEWART ELIZABETH     60 F W                            NC                   1789/1790

This family moved to nearby Polk Co, TN before 1860. I don't have the census listing for them for 1860, but Frances was listed there in 1870 and 1880 with her 2nd husband Spencer Wood. I didn't find Elizabeth Stewart after 1850.

Though it seems reasonable that Elizabeth is somehow connected to the Noah Stewart family, I have no real proof of that. It could be just a coincidence that she lived so near him in 1850.

Sherry Babb, a descendant, reports that Narcissa Hampton Leatherwood's death certificate lists "Charles" Hampton as her father, but has "John" written over Charles, so it isn't clear which one was correct. For the mother it lists simply "Stewart". This does show that Frances was a Stewart before marrying Charles (or John) Hampton, thus confirming (more or less) that Elizabeth was Frances' mother.


Elizabeth Stewart was born ca 1777 (per Lawrence Wood), or ca 1770/74 per the census records that I've found. I haven't found any proof that she is a child of John and Mary Ann, but she did marry in Cabarrus Co, NC in 1796, so that makes her a suspect, and also, Lawrence Wood (deceased) told me he believed she was a part of the John and Mary Ann Stuart family. 

On 11 Nov 1796 John Cromwell obtained a marriage bond in Cabarrus Co, NC to marry Elizabeth Stewart. "John Stewart" was the bondsman. Whether this bondsman was John Stewart Sr, John Jr or another John is unproven.

There were several men named John Cromwell in that area, and the marriage records show several marrying. One of these was a Sheriff of Cabarrus Co, NC at one time. I don't believe the one under study here was the Sheriff.

John Cromwell was listed on the 1800 census in Cabarrus Co, NC. By 1810 John Cromwell and family had moved to Buncombe Co, NC near much of the rest of the John Stuart family.

By 1820 they were gone from NC, and may have moved to nearby Blount Co, TN, where they were listed on the 1830 census. (1820 census was lost for eastern TN, including Blount County). I haven't searched for them in 1840 or 1850 yet, but they might have still been in eastern TN then.

Based on these various tidbits of circumstantial evidence, I feel fairly good about including Elizabeth Stewart Cromwell as a child of John and Mary Ann Stuart.


Ruth Stewart was possible a daughter of John and Mary Ann. The Family Bible record of Jacob Stewart's grand daughter Ruth (1850) (entries written by her daughter, so long after the fact) shows a Ruthie Stewart as a sister of "Jake" Stewart, who married the elder Johnson Moss. (Apparently a younger Johnson Moss was also married to someone named Ruth). I found a Johnson Moss on the 1840 Choctaw Co, MS census, but have no other record of him, nor any information (so far) to confirm this connection. The Family Bible record (in possession of Mitch Watson, shared with me by Carl Stewart) was written no earlier than the 1870's, so probably long after these folks had died. There was also an extensive use of nicknames, so "Johnson" Moss might be someone else. Anyway, I have no additional data on Ruth Stewart. She might be one of the apparent daughters of John and Mary Ann Stuart born ca 1790/1800. 

I found no sign of a "Johnson Moss" on the 1800, 1810 or 1820 census. I personally think that the Bible record is wrong, or that the information was about a younger person. Anyway, I thought I'd include it anyway.


Margaret Stewart was born before 1755. I don't have any proof that she is a child of John and Mary Ann, but she did marry in Cabarrus Co, NC in 1794, so that makes her a suspect. There were a couple of other Stewarts in Cabarrus at that time, mainly from neighboring Mecklenburg County, so she may be part of one of those families. However, a marriage bond was supposed to be filed in the county where the bride resided. Cabarrus County records from this timeframe (1794-1796) show only John Stuart, William Stuart and wife Jean, and Samuel Stewart in this county. Margaret could belong to the William or Samuel Stuart family instead.

On 20 May 1794 James Carothers obtained a marriage bond in Cabarrus Co, NC to marry Margreth Stewart

James Carothers was listed on the 1800 census in Mecklenburg County age 45+ (bef 1755) with a wife the same age. In 1810 no James was listed, but a Margaret Carothers was in Cabarrus, an apparent widow. Perhaps the same person. Her age could indicate she is an older daughter of John Stewart. Whether she is his child or not, I can't say. Due to her age when married (at least 35 then), she may have been a Stewart widow, having been married to a Mr. Stewart who died. This is just speculation though. More research is needed. 

Records in the LDS Ancestral File show this James Carothers dying in Sumner Co, TN in 1811 and having a 2nd wife Jane Irwin married 1800 in TN. I don't know how accurate any of this is, but I thought I should present it as a possible lead.


Abbaja Stuart was born before ca 1773, assuming she was 21 when married in 1794. I don't have any proof that she is a child of John and Mary Ann, but she did marry in Cabarrus Co, NC in 1794, so that makes her a suspect. There were a couple of other Stewarts in Cabarrus at that time, mainly from neighboring Mecklenburg County, so she may be part of one of those families. However, a marriage bond was supposed to be filed in the county where the bride resided. Cabarrus County records from this timeframe (1794-1796) show only John Stuart, William Stuart and wife Jean, and Samuel Stewart in this county. Margaret could belong to the William or Samuel Stuart family instead. 

On 22 Jul 1794 James Cullens obtained a marriage bond in Cabarrus Co, NC to marry Abbaja Stuart

A researcher (who's name I can't locate at the moment) states that the above is actually Olivia Stewart, child of Thomas Stewart who died 1778 in Mecklenburg Co, NC, and that they later moved to Dallas Co, AL. I haven't attempted to confirm or refute this information yet. She listed James' name as "Callen".  

I did not find James Cullens (or similar spellings) on the 1800 census, but in 1810 he was listed in Cabarrus Co, NC. There was a "James Callen" in 1820 and 1830 Dallas Co, AL census. I didn't find them listed there in 1840, though others of that surname were listed, same in 1850.

This family is listed on the LDS Ancestral File with James Callen dying 20 Feb 1842 in Dallas Co, AL. His wife is given there as Olivia H. Stewart born 1762, died 18 Jul 1846 Dallas Co, AL, child of Thomas Stewart and Catherine Allen. Submitter was Jerry L. Smith. I've not been in contact with Mr. Smith.


Delilah Stewart was born ca 1755/74. I don't have any proof that she is a child of John and Mary Ann, but she did marry in Cabarrus Co, NC in 1795, so that makes her a suspect. There were a couple of other Stewarts in Cabarrus at that time, mainly from neighboring Mecklenburg County, so she may be part of one of those families. However, a marriage bond was supposed to be filed in the county where the bride resided. Cabarrus County records from this timeframe (1794-1796) show only John Stuart, William Stuart and wife Jean, and Samuel Stewart in this county. Delilah could belong to the William or Samuel Stuart family instead. 

On 17 Jul 1795 Charles Freeman obtained a marriage bond in Cabarrus Co, NC to marry Delilah Stewert.

Charles Freeman was in Cabarrus on the 1800 census, both in the age 26-44 column (born ca 1755/1774). I didn't find them on the 1810 census. In 1820 I found a Charles A. Freeman in Mecklenburg Co, NC.

In 1830 Charles Freeman was in Cabarrus Co, NC. In 1840 he was back in Mecklenburg Co, NC. In 1850, I didn't find him in North Carolina, so I can't confirm (only from the census) that this was the same Charles through all these census years.

Marriage records in Mecklenburg Co, NC show a Charles Freeman and Nancy Ballard marrying in 1811 and a Charles T. Freeman marrying Margaret Simpson in 1829. Any of these two may be the same Charles listed in the various census records. Also, one of these might be the same Charles who married Delilah Stewart, if she died, and that was his 2nd wife.


Mary Stewart was born before ca 1775, assuming she was 21 when married in 1796. I don't have any proof that she is a child of John and Mary Ann, but she did marry in Cabarrus Co, NC in 1796, so that makes her a suspect. There were a couple of other Stewarts in Cabarrus at that time, mainly from neighboring Mecklenburg County, so she may be part of one of those families. However, a marriage bond was supposed to be filed in the county where the bride resided. On 31 May 1796 Elias Morrison (spelled Morisson) obtained a marriage bond in Cabarrus Co, NC to marry Mary Stewart

I wasn't able to locate Elias Morrison on the 1800, 1810 or 1820 census. I didn't check 1830-1850.
